Specific Cases, Second Chance Law

Valuations for the calculation of the fair value or net asset value of assets or companies.

The Second Chance Law 25/2015 establishes mechanisms so that individual or self-employed debtors, in good faith, and who present a situation of insolvency, can free themselves from their debts or establish a payment mechanism in accordance with their real situation, so that they can remain in the financial and economic system without dragging unpayable debts that could condition their whole life.

The insolvent debtor will be able to choose between totally canceling his debts with the liquidation of his assets or partially canceling them with a payment plan. The practical application of the law in the Courts makes possible different scenarios: liquidating assets, giving them as dation in payment or even the possibility of keeping the habitual residence. 

It is essential that the debtor proves its insolvency at the beginning of the process, justifying the existing debts and valuing its rights and assets in accordance with the requirements established in the insolvency legislation ("according to the report of an Appraisal company approved and registered in the Banco de España in the case of real estate, and valuation by a specialized entity for movable assets"). Thus, the valuation reports must be carried out in accordance with the provisions of the legislation in force, and must include the purposes foreseen and be in accordance with the purpose for which they are intended.
